在意大利购买或销售房产是一个复杂的问题,其中往往会涉及若干专业的领域。在意大利销售/购买房产通常包括三个阶段:

  1. 出售要约 (“Propostale Irrevocabile di Acquisto”);
  2. 预售合同 (“Compromesso” 或 “Contratto Preliminare”);
  3. 最终的购买契据 (“Rogito Notarile”), 其须在意大利公证员面前签署.
  4. 出售要约 (“Propostale Irrevocabile di Acquisto”):
    第一个阶段主要在于书面要约(出售要约)的起草,该要约由感兴趣的买方予以签署,目的在于将该房产在一定时间内从市场上移除(由双方当事人明示同意)。出售要约的签订须附签一张支票(金额相当于要约价格的一小部分),该笔金额由房地产代理公司(如有的话)予以保管或交付给卖方。尽管此出售要约对于双方最后是否签署最终的购买契约不具有约束力,但是买家在签署该出售要约之前仍然要十分注意,因为此协议可能产生法律后果。
  5. 预售合同
    明确规定出售要约的签署不具有强制力是十分重要的。跳过第一步,直接签署预售合同也是可能的,预售合同是正式的购买协议。尽管预售合同的签署并不会产生转移房产所有权的效果,但是有必要在签订之前对相关房产进行初步查勘,因为预售合同在双方当事人之间会产生很多法律约束效果。例如,意大利法院认为房地产代理公司有权在预售合同签订后收取他们的佣金,即使最终的合同并未定案。预售合同必须在合格的意大利税务局进行登记,而且此项登记需要预付部分国税:登记预售合同时所支付的税收金额将从在意大利公证员面前签署最终契据时的总额中予以扣除。

在签署预售合同之后,有必要确保对房产进行尽职调查(法律层面和技术层面),以便核实其是否符合意大利国家和市政相关法规所创设的法律/技术/结构方面的要求。我们的员工包括受托出具房地产技术报告的查勘员。

  1. 最终的购买契据
    最终的购买契据必须在意大利公证员(契据认证的专属授权)面前签署。这个过程无需您亲自到场。我们可以通过准予我们签署协议的PoA(委托书)的形式以您的名义完成。这同样适用于出售要约和预售合同(见上文)。

    2. 房地产经纪人佣金磋商;
    3. 出售要约的起草以及卖方和买方签名的采集以及

    9. 联络房产经纪人,开发商,律师(如果卖方委托了律师),公证人,税务局,公产登记处等等。
    10. 委托我们的查勘员,其将被任命调查相关房产并且起草技术性报告;
    11. 找出产权凭证中的任何瑕疵,建筑规划中的问题,优先购买权问题或拖延磋商问题;
    12. 在意大利开设银行账户的协助;
    13. 建筑物及内部保险安排;

    Buon pomeriggio, voglio comprare una proprietà in Italia.
    Mi piacerebbe sapere come vengono pagate le tasse nel settore immobiliare in Italia, che le tasse vengono pagate una volta a mio nome.
    Comprendo che la notazione costa l’1% del valore di acquisto, la commissione dell’agente immobiliare è compresa tra il 2% e il 3% del valore di acquisto. Ma so che l’iscrizione alla registrazione viene pagata sul valore del catasto, non so a cosa si riferisce, se è il pagamento di un tributo solo una volta che scrivo la proprietà a mio nome o è una tassa annuale? Raccolgo tutte le informazioni possibili. grazie mille!!

    If partners in SLR companies enter into certain agreement with respect of the responsibilities of each party, does the agreement need to be registered / notorised within 3 days for the Agreement to be enforceable in the Italian Cour of Law, otherwise the Agreement will be null and void.       A private agreement between shareholders (of an SRL) must ot be registered or notarized.. by the way with a registration of the agreement, in case you need to enforce it you will have the certain date of the signing. By the way please write us for further details.

    Hello
    I wonder if you mat be able to help me.
    My wife and I jointly own a house in Puglia, Italy which we have had for 9 years.
    We are now in the process of separating and have mutually agreed that the house in Italy will become mine. I intend to use this as my main house and will move there permanently later this year.
    The title deeds are in both of our names and we need to remove my wife from the deed. My wife does not wish to travel to Italy if she does not need to.
    I have been in touch with a Solicitor in Italy who has quoted me 5000 euros which i thought was a quite lot to pay.

    Could you tell me if this is the type of work that you do and whether this figure is what someone would expect to pay for this type of work.?

    Hi, I have a quick question regarding two houses we inherited in Italy near Foggia several years ago. My sister and I own two houses with our other two siblings. The other two siblings refuse to buy our portions, sell theirs, or pay any of the related bills on these properties so that we either have to pay them, or let the government take them. Is there any legal recourse that could resolve this terrible matter? Thank you.
