Decreto Flussi 2024: Moving to Italy

The “Decreto Flussi 2024” (Flows Decree) is an Italian government regulation that sets the number and conditions for the entry of foreign workers to address the demands of Italy’s labor market, benefiting both businesses and private households. As for 2024, the numbers have already been decided within the triennial perspective 2023-2025 (you can refer to this article for further information).

Regarding non-seasonal jobs, employers working in the Italian territory who want to hire a foreign worker are required to apply for an official authorization (nulla osta) to secure a spot within the established quota system. After obtaining this authorization, the prospective employee can then apply for a work visa through the Italian consulate in their home country.

For the 2023-2025 period, the triennial entry quota plan was finalized by the Prime Ministerial Decree (DPCM) on September 27, 2023. Under this plan, Italy will permit a total of 452,000 foreign nationals to enter the country for both seasonal and non-seasonal employment, as well as for self-employment opportunities, distributed as follows:

It is important to note that, while European Union citizens have free access to the Italian labor market, foreign citizens must enter with a work visa.

The established quota system: th Numbers for 2024

In 2024, 151,000 workers will be allowed to enter Italy, divided as follows:

  • 89,050 for seasonal subordinate work
  • 61,950 for non-seasonal subordinate work
  • 700 for self-employed work

The application for a clearance certificate can be submitted for workers from countries that have signed cooperation agreements with Italy:

Decreto Flussi 2024: the Sectors to work in Italy

It’s not solely about whether the foreign workers are from the countries listed, but also about the sectors they can be employed in. The eligible industries for employing foreign workers include:

Seasonal Work in Italy

Before establishing a fixed-term or open-ended employment relationship with a foreigner residing abroad through the annual “Decreto Flussi”, the employer must first check with the competent Agenzia per l’Impiego (Employment Center) for the unavailability of workers already present on the national territory. But this preliminary check for the unavailability of workers on the national territory is not necessary for seasonal workers.

Employer/Company Income Requirement

An income or turnover of at least €30,000 is needed. To work and hire in Italy there’s an income requirements for entry – For all employment sectors: the taxable income, in the case of an individual/Sole Proprietorship, or the turnover, in the case of entities and companies, cannot be less than €30,000.00.

Special quotas for the Family Care Sector

There are 9,500 quotas for the family care and social health sector, which includes family collaborators and assistants (so-called “caregivers”) open to all nationalities of workers.

The expected remuneration must comply with the National Collective Labor Agreement (CCNL) for domestic work and must not be less than €534.41 per month.

In this case, the employer must have an income capacity of €20,000 or €27,000 depending on the family unit. An employer suffering from diseases or disabilities, who intends to hire a person for their assistance, does not need to demonstrate the income requirement and certification.

Decreto Flussi 2024: when Applications Can Be Submitted?

To submit the application, it will be necessary to wait for the “click days”.

Three Click Days for the 2024 “Decreto Flussi”

Even though applications can be completed until December 31, 2024, availability is expected to be exhausted within minutes. Specifically, there will be three Click Days for the 2024 “Decreto Flussi”:

  • February 5, 2024, for non-seasonal subordinate work for citizens from countries that have cooperation agreements with Italy.
  • February 7, 2024, for non-seasonal subordinate work.
  • February 12, 2024, for seasonal work.

Flow Decree Application Procedures

The platform for the pre-compilation of applications is available at https://portaleservizi.dlci.interno.it. Possession of an SPID identity or CIE (Electronic Identity Card) is required. The circular clarifies the procedures for compiling applications and the related attachments.

If an application does not fall within the prescribed quotas based on the chronological order of submission, the employer will see the following message on the ALI portal: “The practice is currently not within the quota.”

Please be aware that before submitting an application, it is necessary to have requested, for certain categories of workers:

  • A certification of the unavailability of national workers from the Employment Center (CPI), and
  • An attestation of the appropriateness of the job offer from professionals or employers’ organizations.
